Terms and Conditions

Welcome to Bluuma. By accessing or using our event website builder platform at www.bluuma.com (the "Service"), you agree to be bound by these Terms and Conditions ("Terms").

If you do not agree with any part of these Terms, you must not use the Service. Your continued use constitutes acceptance of these Terms and any future modifications.

These Terms constitute a legally binding agreement between you and Bluuma Indonesia. We reserve the right to update these Terms at any time, and your continued use after changes indicates acceptance.

Bluuma provides an online platform for creating, customizing, and publishing event websites including:

• Website Builder: Drag-and-drop editor with professionally designed templates
• Event Types: Weddings, birthdays, corporate events, and general purpose websites
• Features: RSVP management, guest book, photo galleries, countdown timers, maps, QR codes
• Hosting: Subdomain hosting (yourname.bluuma.com) and optional custom domain support
• Storage: File storage ranging from 500MB (free) to 10GB (premium plans)
• Analytics: Real-time visitor tracking and engagement metrics

We reserve the right to modify, suspend, or discontinue any feature at any time without prior notice.

Account Creation:

• You must be at least 18 years old or have parental consent to use the Service
• You can register via email or Google OAuth authentication
• You are responsible for maintaining the confidentiality of your account credentials
• You must provide accurate and complete registration information
• One person or entity may not maintain multiple free accounts

Account Security:

• You are solely responsible for all activities under your account
• Notify us immediately of any unauthorized access at bluuma.help@gmail.com
• We are not liable for losses from unauthorized account use
• Do not share your account credentials with others

Account Termination:

We may suspend or terminate accounts that violate these Terms, engage in abusive behavior, or for non-payment. You may delete your account anytime from account settings.

Pricing Plans:

• Free Plan: Limited features with Bluuma branding (no payment required)
• One-Time Payment: Rp 50,000 per website publication (lifetime access)
• Subscription Plans: Monthly/annual subscriptions with enhanced features and storage
• Voucher Packages: Bulk purchase options with discounts
• Premium Add-ons: Custom domains, additional storage, premium sections

Payment Processing:

• All payments processed through Tripay payment gateway in Indonesian Rupiah (IDR)
• Accepted payment methods: Bank transfer, e-wallets, virtual accounts, retail stores
• Prices are inclusive of applicable Indonesian taxes
• Payment must be completed within the timeframe shown at checkout
• Failed payments may result in service suspension

Refund Policy:

• One-Time Payments: Refundable within 7 days if website not yet published
• Subscriptions: No refunds for partial months; cancel anytime to avoid future charges
• Vouchers: Non-refundable once purchased unless unused within 30 days
• Technical Issues: Full refund if we cannot deliver service due to our technical failures

To request a refund, email bluuma.help@gmail.com with your transaction ID and reason.

Your Content:

You retain all ownership rights to content you upload (text, images, videos, audio). By uploading content, you grant Bluuma a license to:

• Store, display, and transmit your content to provide the Service
• Create backup copies for reliability and disaster recovery
• Optimize content for web delivery (compression, format conversion)
• Display your published websites to visitors you invite

This license ends when you delete content or close your account (subject to 30-day backup retention).

Content Responsibility:

• You are solely responsible for all content you upload
• You must own rights or have permission for all content
• You warrant content does not infringe third-party intellectual property
• We may remove content that violates these Terms or Indonesian law

Prohibited Content:

You may not upload content that is: illegal, obscene, defamatory, hateful, violent, harassing, fraudulent, promotes illegal activities, infringes copyrights/trademarks, contains malware, or violates privacy rights.

Storage Allocations:

• Free Plan: 500MB total storage
• Starter Plan: 1GB total storage
• Business Plan: 5GB total storage
• Enterprise Plan: 10GB total storage

Fair Use Policy:

• Storage is for legitimate event website content only
• No file sharing, backup storage, or content distribution unrelated to events
• Excessive bandwidth use may result in throttling or suspension
• We may compress or optimize large files to save space

Exceeding Limits:

If you exceed your storage limit:

1. You'll be notified via email to upgrade or delete files
2. New uploads will be blocked until you free up space
3. After 30 days, we may delete oldest uploaded files to comply with limits
4. Critical files (published site content) are preserved until you upgrade

Bluuma's Intellectual Property:

The Service, including templates, design elements, code, branding, and documentation are owned by Bluuma and protected by:

• Indonesian copyright law (UU No. 28/2014)
• International copyright treaties
• Trademark registrations for "Bluuma" brand

You may not copy, modify, distribute, sell, or reverse engineer any part of the Service.

Template License:

• Templates are licensed for use in creating your event websites
• You may customize templates for your personal/commercial events
• You may not resell, redistribute, or claim templates as your own work
• Premium templates require active subscription or purchase

Trademark Use:

"Bluuma" and associated logos are trademarks. You may not use our trademarks without written permission, except to identify the Service when describing your use.

You agree not to use the Service to:

• Violate any Indonesian laws or regulations (including UU ITE)
• Infringe intellectual property rights of others
• Upload malicious code, viruses, or harmful software
• Attempt to hack, breach security, or disrupt the Service
• Scrape or collect user data without authorization
• Impersonate others or create fake identities
• Spam, phish, or send unsolicited commercial messages
• Host illegal content or promote illegal activities
• Abuse refund policies or commit payment fraud
• Create excessive load through automation or bulk operations
• Resell the Service without written authorization
• Use the Service for any unlawful purpose

Violation may result in immediate account termination and legal action.

Service Availability:

We strive for 99.9% uptime but do not guarantee uninterrupted service. The Service is provided "AS IS" without warranties of:

• Availability, reliability, or error-free operation
• Fitness for a particular purpose
• Merchantability or non-infringement
• Data accuracy or backup reliability

Liability Limits:

To the maximum extent permitted by Indonesian law, Bluuma shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Lost profits, data loss, or business interruption
• Damages exceeding the amount you paid in the last 12 months
• Issues caused by your misuse, third-party services, or force majeure

User Responsibility:

• Maintain backups of your content - we are not responsible for data loss
• Test your websites before important events
• Ensure content compliance with applicable laws
• Monitor your account for unauthorized access

Informal Resolution:

Before filing any legal claim, you agree to contact us at bluuma.help@gmail.com to attempt informal resolution. We will work in good faith to resolve disputes within 30 days.

Jurisdiction:

• These Terms are governed by Indonesian law
• All disputes shall be resolved in Indonesian courts
• You consent to jurisdiction in Jakarta courts for legal proceedings
• Indonesian language version of Terms prevails in case of translation discrepancies

Arbitration (Optional):

By mutual agreement, disputes may be resolved through binding arbitration under Indonesian Arbitration Board (BANI) rules, with proceedings in Jakarta.

These Terms are governed by the laws of the Republic of Indonesia, including:

• UU ITE (Law No. 11/2008 as amended): Electronic Information and Transactions
• UU Perlindungan Konsumen (Law No. 8/1999): Consumer Protection
• UU Hak Cipta (Law No. 28/2014): Copyright
• PP No. 71/2019: Electronic Systems and Transactions Regulation

You agree to comply with all applicable Indonesian laws when using the Service. Cross-border users must also comply with laws in their jurisdiction.

We may modify these Terms at any time. When we make changes:

• Updated Terms will be posted on this page with a new "Last Updated" date
• Significant changes will be notified via email to registered users
• Your continued use after changes constitutes acceptance
• If you disagree with changes, stop using the Service and close your account

We recommend reviewing these Terms periodically. Material changes take effect 30 days after posting.
